Welcome to the website of KRAZ Booth LLC, operating as KZ PhotoBooth Rental (collectively, "we," "us," or "our"). These Terms of Service ("Terms") govern your use of our website at kzphotobooth.com (the "Site").
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. What This Site Is — and Is Not
The Site is a marketing and information resource for our photo booth rental services. Browsing the Site, submitting a quiz response, or sending us an inquiry does not create a binding rental contract.
Actual rental services are governed by a separate written agreement between you and us, typically delivered and signed through our booking partner HoneyBook. That agreement — not these Terms — controls all matters relating to your event, including payment, cancellation, equipment, attendant services, and our obligations on the day of your event.
2. Eligibility
You must be at least 18 years old to submit a booking inquiry or enter into a rental agreement with us. By using the Site, you represent that you meet this requirement.
3. Intellectual Property
All content on the Site — including text, graphics, logos, photographs, videos, designs, the KZ diamond logo, the names "KZ Photo Booth Rental," "KRAZ Booth," "The Badlands," "The Prairie," and "The Missouri," and all software — is owned by or licensed to KRAZ Booth LLC and is protected by United States and international copyright, trademark, and other intellectual property laws.
You may view, share, and link to the Site for personal, non-commercial purposes. You may not copy, reproduce, modify, distribute, publicly display, or create derivative works from any Site content without our prior written permission.
4. Submitted Information
When you submit information through the Site — for example, through the Booth Finder quiz or a contact form — you confirm that the information is accurate and that you have the right to submit it. We will use submitted information as described in our Privacy Policy.
5. Acceptable Use
You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms
- Attempt to interfere with, disrupt, or compromise the security of the Site
- Use automated tools (bots, scrapers, crawlers) to collect information from the Site without our permission, except for standard search engine indexing
- Impersonate any person or misrepresent your affiliation with any person or entity
- Submit any content that is unlawful, defamatory, harassing, or otherwise objectionable
- Use the Site to send unsolicited commercial communications
We reserve the right to refuse service, terminate access, or remove content at our discretion.
6. Third-Party Services and Links
The Site uses and links to third-party services, including HoneyBook (for booking and payments), Templates Booth (for browsing print templates), Netlify (for hosting and form processing), Google Analytics, Meta (Facebook) Business, and our social media accounts. We are not responsible for the content, accuracy, availability, or practices of any third-party service.
Your use of any third-party service is governed by that service's own terms and privacy policy. When you click a link that takes you to HoneyBook to submit a booking inquiry, your interactions with HoneyBook are subject to HoneyBook's terms — not ours.
7. Pricing Information
Starting prices and package descriptions shown on the Site are for general information only and may change at any time without notice. The actual price of your booking will be set out in the written rental agreement we send you through HoneyBook and will depend on the booth type, package level, event date, location, duration, add-ons, and other factors.
8. Refunds, Cancellations, and Rescheduling
The Site does not process payments and does not control refund or cancellation outcomes. All payments, deposits, refunds, cancellations, and rescheduling for booked events are governed exclusively by the written rental agreement you sign through our booking partner HoneyBook. That agreement, not these Terms, controls:
- Deposit amounts, due dates, and whether deposits are refundable
- Cancellation windows and any associated fees
- Rescheduling rights and procedures
- Refunds in the event we cannot fulfill the booking
- Force majeure (weather, illness, venue closures, and similar events outside our control)

9. Disclaimers
The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties of any kind, whether express, implied, statutory, or otherwise, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.
We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information on the Site.
10. Limitation of Liability
To the fullest extent permitted by law, in no event will KRAZ Booth LLC, its officers, members, employees, agents, or affiliates be liable to you for any indirect, incidental, special, consequential, or punitive damages — including without limitation lost profits, lost revenue, loss of data, or business interruption — arising out of or related to your use of the Site, even if we have been advised of the possibility of such damages.
Our total liability to you for all claims arising out of or related to the Site or these Terms will not exceed one hundred dollars ($100). This limitation does not apply to liability that cannot be limited under applicable law.
Liability for matters relating to a booked event is governed by the separate written rental agreement, not by these Terms.
11. Indemnification
You agree to defend, indemnify, and hold harmless KRAZ Booth LLC and its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Site or your violation of these Terms.
12. Governing Law and Venue
These Terms and any dispute arising out of or related to them or the Site are governed by the laws of the State of North Dakota, without regard to its conflict-of-laws principles. You agree that any action arising out of or related to these Terms or the Site will be brought exclusively in the state or federal courts located in Burleigh County, North Dakota, and you consent to the personal jurisdiction of those courts.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we'll change the "Last updated" date at the top of this page. Significant changes will be communicated through the Site. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
14. Entire Agreement; Severability
These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Site. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
